Overview
Welcome to Mon Animal Gourmet. The terms "we," "our," and "us" refer to Mon Animal Gourmet, a sole proprietorship. Mon Animal Gourmet operates the online shop www.monanimalgourmet.ch via Shopify, to offer you quality food products and accessories for your pets.

These Terms of Service, together with the associated policies (returns, privacy, shipping), constitute the entire agreement between you and Mon Animal Gourmet regarding the use of the Services.

By visiting or using our Services, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree to these terms, please do not use our Services.

Section 1 — Access and Account
By accepting these Terms of Service, you confirm that you are at least 18 years of age and have the legal capacity to enter into a contract. You are responsible for keeping your account credentials confidential and for all activities carried out from your account. You agree to provide accurate, complete, and up-to-date information.

Section 2 — Our Products
We offer food products, treats, supplements, and accessories for pets, sourced from our partners Animéco and Joy's Food, and shipped from our own stock in Switzerland. We strive to accurately represent our products. Colors and appearance may vary slightly depending on your screen. The compositions and nutritional information displayed are those provided by our suppliers and may change. If in doubt about a product's composition (allergens, specific diet), contact us before ordering. We reserve the right to modify product descriptions, prices, or withdraw a product at any time, without prior notice.

Section 3 — Orders
When you place an order, you are making an offer to purchase. Mon Animal Gourmet reserves the right to accept or refuse any order at its discretion. The order is accepted upon receipt of the email confirmation and payment. Purchases may only be returned or refunded in accordance with our Return & Refund Policy. Your purchases are intended for your personal use or the use of your pets, and not for commercial resale.

Section 4 — Pricing and Billing
Prices are listed in Swiss francs (CHF), all taxes included (VAT included). Shipping costs are shown separately at checkout. Prices may be changed without notice. The applicable price is the one in effect at the time the order is confirmed, as shown in the confirmation email.

Section 5 — Payment Methods
Payments are accepted via:

  • Credit card: Visa, Mastercard, American Express, UnionPay
  • Digital wallets: Apple Pay, Google Pay, Shop, Twint

All payments are secured via Shopify's PCI-DSS certified providers. Mon Animal Gourmet does not store any banking data.

Section 6 — Shipping and Delivery
Orders are shipped directly from our warehouse located in Morges, Switzerland, within 24 hours of payment confirmation. The timeframes given are estimates and do not constitute a contractual commitment. As shipping is done entirely from within Switzerland, no customs formalities or import duties apply. The risk of loss of products transfers to the customer upon actual delivery of the parcel, in accordance with Swiss sales law.

Section 7 — Liability Related to Food Products
Mon Animal Gourmet strives to offer quality products suited to pets. However:

  • The customer is responsible for verifying that products are suited to their pet's specific needs (age, breed, health condition, allergies)
  • In case of doubt, it is recommended to consult a veterinarian before introducing any new product
  • Mon Animal Gourmet cannot be held liable for an individual pet's reaction to a product, within the limits provided by Swiss law

Section 8 — Intellectual Property
All content on the site (texts, images, logos, graphics) is protected by copyright and belongs to Mon Animal Gourmet or its partners. Any reproduction, even partial, is prohibited without prior written authorization.

Section 9 — Privacy Policy
All personal data collected through the Services is processed in accordance with our Privacy Policy and the nFADP (Swiss Federal Act on Data Protection). As the Services are hosted by Shopify, some data is also processed by Shopify in accordance with their own privacy policy (https://privacy.shopify.com/en).

Section 10 — Prohibited Uses
You may only use the Services for lawful purposes. Prohibited uses include: use for illegal purposes, infringement of intellectual property rights, transmission of fraudulent content, harassment, spam, or any action compromising the security of the site.

Section 11 — Limitation of Liability
Within the limits provided by Swiss law, Mon Animal Gourmet's liability is limited to the amount of the order concerned for proven material damages resulting from our fault. This limitation does not apply to bodily injury or cases of gross or intentional misconduct, in accordance with Articles 99 and 100 of the Swiss Code of Obligations (CO).

Section 12 — Applicable Law and Jurisdiction
These Terms of Service are governed by Swiss law. In the event of a dispute, the parties will endeavor to find an amicable solution by contacting contact@monanimalgourmet.ch. Failing that, the Swiss courts of the Canton of Vaud (Morges) shall have exclusive jurisdiction, subject to any mandatory provisions applicable at the consumer's place of residence.

Section 13 — Changes
We reserve the right to modify these Terms of Service at any time. Any modification will be published on this page with an updated date. Continued use of the Services after a modification constitutes acceptance of the new terms.
